Welcome to TradesMatePro. By accessing or using our field service management platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using TradesMatePro's services, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our services.

2. Description of Service

TradesMatePro provides a cloud-based field service management platform designed for trade professionals and contractors. Our services include job scheduling, invoicing, customer management, payroll tracking, and related features.

3. Account Registration and Security

To use TradesMatePro, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 18 years old or the age of majority in your jurisdiction

You are responsible for all activities that occur under your account.

4. SMS and Text Messaging Terms

By providing your mobile phone number and consenting to SMS notifications, you agree to receive text messages from TradesMatePro.

Types of Messages

You may receive SMS messages including, but not limited to:

• Account alerts and notifications
• Job and appointment reminders
• Payment and invoice notifications
• Customer communication alerts
• Important service updates

Consent and Opt-Out

• Opt-In: Your consent to receive SMS messages is not a condition of purchase or service use, but certain features may require SMS notifications to function properly
• Opt-Out: You may opt out at any time by replying STOP to any text message. You will receive a confirmation message. After opting out, you will no longer receive SMS messages unless you opt back in
• Help: For help, reply HELP to any message or contact support at jerry@tradesmatepro.com

Message Frequency and Costs

• Message frequency varies based on your account activity and notification settings
• Message and data rates may apply based on your mobile carrier's plan
• TradesMatePro is not responsible for carrier charges

Supported Carriers

Our SMS service is supported by major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

5. Subscription and Billing

TradesMatePro operates on a subscription basis:

• Base Plan: $20 per user per month
• Field Tech Lite: $5 per user per month
• Additional features available as pay-per-use add-ons

Subscriptions automatically renew unless canceled. You are responsible for all charges incurred under your account.

6. Payment Processing

TradesMatePro may facilitate payment processing between you and your customers. You agree to:

• Comply with all payment processor terms and requirements
• Provide accurate payment and business information
• Be responsible for all taxes and fees associated with your transactions

7. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malware, viruses, or malicious code
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm others
• Send spam or unsolicited communications through our platform

8. Intellectual Property

TradesMatePro and its content, features, and functionality are owned by TradesMatePro and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer our platform without explicit permission.

9. User Content

You retain ownership of content you upload to TradesMatePro. By uploading content, you grant us a license to use, store, and display that content solely to provide our services to you.

10. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to:

• Modify or discontinue features with or without notice
• Perform maintenance that may temporarily limit access
• Update these Terms at any time

11. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the service ceases immediately.

12. Disclaimers and Limitation of Liability

TradesMatePro is provided "as is" without warranties of any kind. To the fullest extent permitted by law:

• We disclaim all warranties, express or implied
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months

13. Indemnification

You agree to indemnify and hold harmless TradesMatePro from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

14. Third-Party Services

TradesMatePro may integrate with third-party services (e.g., payment processors, SMS providers, accounting software). Your use of third-party services is subject to their respective terms and privacy policies.

15. Governing Law

These Terms shall be governed by the laws of the United States and the state in which TradesMatePro is registered, without regard to conflict of law provisions.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the platform. Your continued use of TradesMatePro after changes constitutes acceptance of the modified Terms.
